If there is a subscription form on the company's website, it must include:
- One or more consent checkboxes
- ... with accompanying consent text.
The consent checkbox must NOT be pre-checked; the user must actively give their consent. The consent text should clearly state what the user is signing up for (the type of information, how frequently it will be sent) and must clearly explain how the data will be stored and for how long. (You can, of course, link to your data policy.)
Note: If you intend to use contact data to communicate across different channels, there must be separate consent for each channel.
Example:
To communicate with the contact via both email and SMS, the contact must provide two separate consents, one for each channel.
If, for instance, the contact has provided their phone number in the form shown above but only consented to being called, you are not permitted to send SMS messages to that contact.
TIPS
While updating your subscription form, take the opportunity to ensure that your subscription registration form is working properly. If you lack a double opt-in function, make sure to add it.
How do I update my existing form?
The easiest way is to generate new form code in your Ungapped account. This new code should then replace the existing code on your website.
The consent text and the date when the consent was given can then be found on the contact's profile card (under the Consents tab).
Do I really need a consent checkbox? It’s already very clear what the contact is signing up for, and I have a double opt-in function.
Maybe not. But we believe in the principle of "better safe than sorry." Additionally, the consent text and the date when the consent was given are saved directly on the contact’s profile card, which is convenient.
