Disclosing email source

Do you tell your receiver from where you have got their contact details? No? Then it’s time to do it. According to current legislation, if you contact a private individual via email marketing, you must indicate where the address source came from.

So, what are the rules? In brief, the following applies:

  • The address source refers to the company or register from which you (the marketer) obtained the recipient's address.
  • Emails sent to consumers must include information about the address source.
  • The information about the address source must include an address and phone number so the recipient can contact the source.
  • Contact information doesn’t need to be included if there is reason for you to believe that the addressee understands where the address has been obtained, for example, as a result of the customer relationship, membership, ordering information etc

Even when emailing businesses, it is good practice, though not mandatory, to provide information about the address source.
